By signing up for or using Examiner AI (the “Service”), you agree to the following terms and conditions (“Terms”). Please read these Terms carefully. If you disagree with any part of these Terms, you may not access the Service.

  1. About Examiner AI

    1. Examiner AI is a service provided by Tutor2u Limited, a company registered in England and Wales with its registered address at Coach House, 212 High Street, Boston Spa, West Yorkshire, LS23 6AD.

  2. Changes to terms

    1. We reserve the right to modify or replace these Terms at any time, at our sole discretion. Any changes will be posted on this page, and the “Last Updated” date at the top will be updated accordingly.
    2. It is your responsibility to periodically review these Terms. Your continued use of the Service after any changes are posted constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, please discontinue use of the Service.
  3. Subscription, fees, and usage

    1. Subscription: By subscribing to Examiner AI, you agree to pay the applicable fees as stated on our website or in our promotional materials (unless otherwise specified as a credit-based system—please see Clause 13).
    2. Fair use: Our aim is not to restrict individual users from using the Service; however, users must adopt ‘fair use’ behaviour. Usage quotas (if any) for certain AI features may refresh on a periodic basis (e.g., every 28 days). We reserve the right to immediately terminate or suspend any account we determine is using the Service excessively or in a manner inconsistent with typical educational or professional usage.
    3. Single-user accounts: You agree that each subscription or credit package is for one user only. We reserve the right to terminate or suspend accounts without notice if we believe multiple individuals are using a single account.
  4. Accounts

    1. Account creation: When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your password and any activities that occur under your account.
    2. Password security: You agree not to disclose your password to any third party. You must notify us immediately of any unauthorised use or breach of security regarding your account.
    3. Prohibited sharing: Sharing account credentials is strictly prohibited. Accounts found to be in violation of this rule will be subject to immediate suspension or termination.
  5. User conduct

    1. You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit the use of the Service by, any other party.
    2. Prohibited behaviours include, but are not limited to:
      1. Uploading or transmitting any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
      2. Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
      3. Uploading content containing viruses, worms, or other malicious code.
      4. Attempting to “jailbreak” or otherwise modify the AI models in a manner that prevents them from operating as intended.
    3. We reserve the right to terminate or suspend accounts without notice if these rules are violated.
  6. AI accuracy and limitations

    1. The Service utilises artificial intelligence to generate marking content and provide feedback. While we strive to provide accurate and useful outputs, we do not guarantee the accuracy, completeness, or reliability of any AI-generated material.
    2. You acknowledge that AI-generated content may contain errors or omissions, and that you use such content at your own risk. We are not responsible for any decisions or actions taken based on AI-generated content.
  7. Use of submitted content

    1. By using the Service, you agree that Tutor2u Limited may access and use samples of the content you submit (“Submitted Content”) strictly for internal testing, debugging, and quality control purposes.
    2. We will not retain any personally identifiable information that could be used to identify the author of the original content. Any content used for testing will be anonymised so that it cannot be traced back to you.
    3. Once the Submitted Content is no longer required for internal testing or quality control, it will be securely deleted from our servers and will not be retained in any form.
    4. You agree not to upload or submit any content that explicitly identifies the author of that content (such as a student’s name, centre number, or other unique identification marks). You must take all reasonable steps to ensure that no personal or identifying information is included in the Submitted Content. Tutor2u Limited shall not be held liable for any personal data breaches or disclosures that occur due to your failure to remove such identifying information prior to submission.
  8. Indemnity

    1. You agree to indemnify, defend, and hold harmless Tutor2u Limited, its directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with:
      1. Your use of the Service.
      2. Your violation of these Terms.
      3. Your violation of any third-party rights, including intellectual property rights.
  9. Limitation of liability

    1. In no event shall Tutor2u Limited, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.
    2. Our total liability for any claim relating to the Service shall not exceed the total amount paid by you to Tutor2u Limited for the use of the Service in the one (1) month preceding the event giving rise to the claim.
  10. Data protection and privacy

    1. Data controller: Tutor2u Limited acts as a data controller in relation to the personal information you provide to set up and manage your account. Our privacy policy applies.
    2. In relation to any personal data you input into our AI tools, Tutor2u Limited acts as a data processor.
    3. By using the Service, you consent to the collection and use of your personal data as outlined in our Privacy Policy.
  11. Intellectual property

    1. The Service and its original content, features, and functionality are owned by Tutor2u limited and its licensors and are protected by United Kingdom and international copyright, trademark, and other intellectual property laws.
    2. User-generated resources: Any educational resources, materials, or content you generate using Examiner AI remain your property. Tutor2u Limited does not claim ownership or copyright over content you create. You retain all rights to use, distribute, and modify your content as you see fit outside of our platform.
  12. Termination

    1. We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion.
    2. Provisions of these Terms which by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall remain in effect.
    3. We reserve the right to terminate or suspend accounts that have been inactive for a period of two (2) years, at our sole discretion. If your account is terminated for inactivity, any stored data may be deleted without refund. To request reactivation, contact us at support@tutor2u.net.
  13. Refund and cancellation policy

    1. Credits purchased to use Examiner AI: Access to premium tools in Examiner AI is provided via purchased credits. Credits are consumed upon completion of each individual marking evaluation. If you cancel within 14 days of your first payment and have not accessed any premium AI tools, you may be entitled to a full refund. After 14 days, no refunds will be provided, and access will continue until all purchased credits have been used. Unused credits will not be refunded.
  14. Cancellation or refund requests

  15. Force majeure

    1. Tutor2u Limited will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, or governmental actions.
  16. International use and legal compliance

    1. The Service is controlled and operated from the United Kingdom. We make no representation that the Service is appropriate or available for use in other jurisdictions. If you choose to access the Service from outside the UK, you do so on your own initiative and are responsible for compliance with local laws.
  17. Third-Party services and links

    1. The Service may contain links to third-party websites or services that are not owned or controlled by Tutor2u Limited. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
    2. You acknowledge and agree that Tutor2u Limited shall not be liable for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.
  18. Rewards and incentives

    1. From time to time, we may offer rewards or incentives for using the Service. The terms of such programmes will be determined at our sole discretion and may be changed or withdrawn at any time without prior notice.
    2. Rewards or incentives are non-transferable and cannot be exchanged for cash or other forms of credit unless explicitly stated.
  19. Age restrictions

    1. You must be 18 years or older to create an account and use Examiner AI. If you are under 18, you may only use the Service under the supervision and with the consent of a parent, guardian, or teacher.
    2. By allowing an individual under the age of 18 to use the Service, you confirm that you have obtained all necessary consents and accept full responsibility for that individual’s actions while using the Service.
  20. Governing law and jurisdiction

    1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
    2. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  21. Entire agreement

    1. These Terms constitute the entire agreement between you and Tutor2u Limited regarding your use of Examiner AI and supersede any prior agreements or understandings, whether written or oral.
    2. Any failure by Tutor2u Limited to enforce any right or provision of these Terms will not be considered a waiver of those rights.
